At Talksy Listener, we are committed to maintaining a safe environment and have zero tolerance for child sexual abuse and exploitation (CSAE). This Child Safety Policy outlines our practices, procedures, and commitment to preventing, detecting, and responding to any instances of child abuse material or exploitation.

As a listener on our platform, you play a critical role in maintaining a safe community. This policy applies to all listeners and outlines your responsibilities in protecting children and preventing abuse.

1. AGE REQUIREMENTS

Strict 18+ Policy:

  • Talksy Listener is exclusively for users who are 18 years of age or older
  • All listeners must confirm they are 18+ during the registration process
  • We do not knowingly allow individuals under 18 to provide services on our platform
  • Any listener found to be under 18 will have their account immediately terminated
  • Listeners must verify they will not provide services to any individual they suspect is under 18

2. ZERO TOLERANCE POLICY

We maintain zero tolerance for:

  • Child Sexual Abuse Material (CSAM)
  • Child Sexual Abuse and Exploitation (CSAE)
  • Grooming or solicitation of minors
  • Any content that sexualizes, endangers, or exploits children
  • Attempts to use our platform to harm children in any way
  • Providing services to any individual suspected of being under 18

Violations will result in immediate account termination, permanent ban from the platform, and reporting to appropriate law enforcement authorities.

3. LISTENER RESPONSIBILITIES

As a listener, you are required to:

  • Verify Caller Age: If you have any reason to believe a caller is under 18, immediately end the call and report it
  • Report Suspicious Activity: Immediately report any suspected minors, grooming behavior, or child safety concerns
  • Refuse Service: Do not provide services to anyone you suspect is under 18, regardless of what they claim
  • Maintain Professional Boundaries: Never engage in inappropriate conversations that could endanger children
  • Cooperate with Investigations: Fully cooperate with any safety investigations or law enforcement inquiries
  • Stay Informed: Review this policy regularly and stay updated on child safety best practices

⚠️ Warning Signs to Watch For:

  • Caller sounds very young or mentions being underage
  • Caller discusses school, homework, or age-specific activities suggesting they are a minor
  • Caller requests inappropriate conversations or tries to share personal information
  • Any behavior that raises concerns about the caller's age or safety

If you observe any of these, END THE CALL IMMEDIATELY and report it.

4. PREVENTION MEASURES

Technical Safeguards:

  • Phone Verification: All users (callers and listeners) must verify their phone number via OTP
  • Age Verification: Both callers and listeners must confirm they are 18+ during registration
  • Listener Approval Process: All listeners undergo an approval process before providing services
  • Terms Acceptance: Users must agree to our Terms of Service which explicitly prohibit minors
  • No Public Content: Platform does not allow public sharing of photos, videos, or user-generated content beyond private calls
  • Ephemeral Communication: Calls are not recorded or stored by default, reducing risk of CSAM distribution

Platform Design:

  • Audio/video calls are private and encrypted
  • No messaging or file sharing features that could be misused
  • No public profiles or social networking features
  • Limited data collection to minimize risk
  • In-call reporting button for immediate safety concerns

5. DETECTION AND MONITORING

Our monitoring practices include:

  • Regular review of listener reports and flagged accounts
  • Investigation of suspicious activity patterns
  • Compliance monitoring for age verification
  • Review of listener conduct and adherence to safety policies
  • Cooperation with law enforcement investigations

Note: We do NOT monitor the content of private calls, as they are not recorded. Monitoring focuses on metadata, user reports, and account behavior.

6. LISTENER REPORTING

In-App Reporting:

  • Listeners can report concerns directly within the app during or after a call
  • Report button (red shield icon) is prominently displayed during active calls
  • Reports can be submitted for:
    • Suspected minors on the platform
    • Harassment or inappropriate behavior from callers
    • Child safety concerns
    • Other violations of our Terms of Service
  • All reports are reviewed within 24 hours
  • Urgent safety concerns are escalated immediately

How to Report as a Listener:

  1. During a call: Tap the red shield "Safety Options" button in the top-right corner
  2. Select "Report User"
  3. Choose the reason for reporting (Harassment, Inappropriate Content, Spam, or Other)
  4. Provide additional details describing your concern
  5. Submit the report
  6. If the concern is urgent (suspected minor), end the call immediately after reporting

External Reporting:

7. RESPONSE PROCEDURES

When CSAM, CSAE, or suspected minor activity is reported:

  1. Immediate Action:
    • Offending account is immediately suspended
    • User is prevented from creating new accounts or receiving calls
    • Associated metadata is preserved for investigation
    • If a listener reported the concern, they are protected from retaliation
  2. Investigation:
    • Our safety team reviews the report within 24 hours (urgent reports immediately)
    • Evidence is collected and documented
    • Additional related accounts are investigated
    • Listener cooperation may be requested for additional details
  3. Law Enforcement Notification:
    • Confirmed CSAM/CSAE is reported to the National Center for Missing & Exploited Children (NCMEC) via CyberTipline
    • Reports are also made to local law enforcement as required by jurisdiction
    • We cooperate fully with law enforcement investigations
    • Legal holds are placed on relevant data pending investigation
  4. Platform Action:
    • Permanent account termination
    • Ban on phone number and associated identifiers
    • Content removal (if applicable)
    • Listener protection measures if needed

8. LEGAL COMPLIANCE

We comply with all applicable laws including:

  • 18 U.S.C. § 2258A (Reporting of CSAM by electronic communication service providers)
  • Children's Online Privacy Protection Act (COPPA) - by prohibiting users under 18
  • India's Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021
  • India's Protection of Children from Sexual Offences (POCSO) Act, 2012
  • All regional and national child protection laws in jurisdictions where we operate

Mandatory Reporting:

  • We report all instances of known or suspected CSAM to NCMEC and appropriate authorities
  • Reports include all required information per legal obligations
  • We maintain records of reports for legal compliance
  • We respond promptly to all law enforcement requests
  • Listeners may be contacted to provide information for investigations

9. LISTENER TRAINING AND SUPPORT

  • All listeners receive guidance on child safety policies during onboarding
  • Listeners are provided with clear reporting procedures and safety tools
  • Regular updates on child safety policies and evolving threats
  • Support available for listeners who encounter concerning situations
  • Clear escalation procedures for urgent safety issues

10. CONSEQUENCES FOR VIOLATIONS

Listener violations of child safety policies will result in:

  • Immediate suspension of listener account
  • Permanent termination and ban from the platform
  • Forfeiture of any pending earnings
  • Reporting to law enforcement if criminal activity is suspected
  • Cooperation with all investigations and legal proceedings

There are NO exceptions to our child safety policies. Any listener who violates these policies will be immediately and permanently removed from the platform.
