Protecting children and preventing abuse

At Talksy, we are committed to maintaining a safe environment and have zero tolerance for child sexual abuse and exploitation (CSAE). This Child Safety Policy outlines our practices, procedures, and commitment to preventing, detecting, and responding to any instances of child abuse material or exploitation.

1. AGE REQUIREMENTS

Strict 18+ Policy:

  • Talksy is exclusively for users who are 18 years of age or older
  • Users must confirm they are 18+ during the registration process
  • We do not knowingly collect information from or market to children under 18
  • Any user found to be under 18 will have their account immediately terminated

2. ZERO TOLERANCE POLICY

We maintain zero tolerance for:

  • Child Sexual Abuse Material (CSAM)
  • Child Sexual Abuse and Exploitation (CSAE)
  • Grooming or solicitation of minors
  • Any content that sexualizes, endangers, or exploits children
  • Attempts to use our platform to harm children in any way

Violations will result in immediate account termination, content removal, and reporting to appropriate law enforcement authorities.

3. PREVENTION MEASURES

Technical Safeguards:

  • Phone Verification: All users must verify their phone number via OTP
  • Age Verification: Users must confirm they are 18+ during registration
  • Terms Acceptance: Users must agree to our Terms of Service which explicitly prohibit minors
  • No Public Content: Our platform does not allow public sharing of photos, videos, or user-generated content beyond private calls
  • Ephemeral Communication: Calls are not recorded or stored, reducing risk of CSAM distribution

Platform Design:

  • Audio/video calls are private and encrypted
  • No messaging or file sharing features that could be misused
  • No public profiles or social networking features
  • Limited data collection to minimize risk

4. DETECTION AND MONITORING

Our monitoring practices include:

  • Regular review of user reports and flagged accounts
  • Investigation of suspicious activity patterns
  • Compliance monitoring for age verification
  • Cooperation with law enforcement investigations

Note: We do NOT monitor the content of private calls, as they are not recorded. Monitoring focuses on metadata, user reports, and account behavior.

5. USER REPORTING

In-App Reporting:

  • Users can report concerns directly within the app during or after a call
  • Report button is prominently displayed during active calls
  • Reports can be submitted for:
    • Harassment or inappropriate behavior
    • Suspected minors on the platform
    • Child safety concerns
    • Other violations of our Terms of Service
  • All reports are reviewed within 24 hours
  • Urgent safety concerns are escalated immediately

How to Report:

  1. During a call: Tap the "Report User" button
  2. Select the reason for reporting
  3. Provide additional details (optional)
  4. Submit the report

External Reporting:

6. RESPONSE PROCEDURES

When CSAM or CSAE is reported or detected:

  1. Immediate Action:
    • Offending account is immediately suspended
    • User is prevented from creating new accounts
    • Associated content/data is preserved for investigation
  2. Investigation:
    • Our safety team reviews the report within 24 hours
    • Evidence is collected and documented
    • Additional related accounts are investigated
  3. Law Enforcement Notification:
    • Confirmed CSAM/CSAE is reported to the National Center for Missing & Exploited Children (NCMEC) via CyberTipline
    • Reports are also made to local law enforcement as required by jurisdiction
    • We cooperate fully with law enforcement investigations
    • Legal holds are placed on relevant data pending investigation
  4. Platform Action:
    • Permanent account termination
    • Ban on phone number and associated identifiers
    • Content removal (if applicable)

7. LEGAL COMPLIANCE

We comply with all applicable laws including:

  • 18 U.S.C. ยง 2258A (Reporting of CSAM by electronic communication service providers)
  • Children's Online Privacy Protection Act (COPPA) - by prohibiting users under 18
  • India's Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021
  • India's Protection of Children from Sexual Offences (POCSO) Act, 2012
  • All regional and national child protection laws in jurisdictions where we operate

Mandatory Reporting:

  • We report all instances of known or suspected CSAM to NCMEC and appropriate authorities
  • Reports include all required information per legal obligations
  • We maintain records of reports for legal compliance
  • We respond promptly to all law enforcement requests

8. STAFF TRAINING

  • All team members receive training on child safety policies and procedures
  • Support staff are trained to identify and escalate child safety concerns
  • Regular updates on evolving threats and best practices
  • Clear escalation procedures for urgent safety issues

9. LISTENER VERIFICATION

Additional safeguards for listeners (service providers):

  • Listeners must be 18+ and verify their age
  • Listeners agree to additional Terms of Service acknowledging child safety responsibilities
  • Listeners are required to report any suspected minors or inappropriate behavior
  • Violation of child safety policies results in immediate listener removal and account ban
